1. Acceptance of Terms
By downloading, installing, or using Omni Merge ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Omni Merge is a merge puzzle game where players swipe to merge ball characters on a 4×4 grid, progressing through 15 tiers. The App features cosmetic skin packs, an undo system, global leaderboards via Apple Game Center, and iCloud score synchronization. The game is available on iOS, iPadOS, and Mac (Designed for iPad) through the Apple App Store.
3. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on any Apple device you own or control, subject to these Terms and Apple's App Store Terms of Service.
4. User Responsibilities
When using Omni Merge, you agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App in any way that could damage, disable, or impair the service
- Not exploit bugs, glitches, or vulnerabilities to gain an unfair advantage
- Not use cheats, automation software, hacks, or any unauthorized third-party tools
- Not manipulate scores or leaderboard rankings through any illegitimate means
5. Game Content
Omni Merge includes virtual items such as cosmetic skin packs that change the appearance of the ball characters. All 3 skin packs (Classic, Gentleman, and The Others) are included free with the App. These virtual items:
- Have no real-world monetary value and cannot be exchanged for cash or any form of currency
- Are provided solely for entertainment and personalization within the App
- Are included free of charge — no purchase is required to access any skin pack
Scores and leaderboard rankings are for entertainment purposes only and do not confer any real-world prizes, rewards, or monetary value.
6. Intellectual Property
The App, including its design, artwork, ball characters, animations, visual effects, sound effects, code, and all other content, is owned by Omni Merge and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content.
7. User Data
Game data such as high scores, equipped skin pack, and preferences are stored locally on your device. If iCloud is enabled, your best score may be synchronized across your Apple devices via your personal iCloud account. By using iCloud sync, you agree to Apple's iCloud Terms and Conditions for the storage and synchronization of your data.
8. Third-Party Services
The App integrates with the following third-party services:
- Google AdMob: Used to display advertisements within the App. Subject to Google's Privacy Policy and Terms of Service. Ad personalization depends on your device settings and consent given at first launch.
- Apple Game Center: Used for global leaderboards and player authentication. Subject to Apple's Game Center Terms and Conditions.
- iCloud: Used for optional cross-device synchronization of your best score. Subject to Apple's iCloud Terms and Conditions.
- App Store / StoreKit: Used for processing in-app purchases. Subject to Apple Media Services Terms and Conditions.
We are not responsible for the availability, accuracy, or content of these third-party services.
9. In-App Purchases
Omni Merge offers the following optional in-app purchase:
- Remove Ads ($1.99): A one-time purchase that permanently removes all interstitial advertisements from the App.
All 3 skin packs (Classic, Gentleman, and The Others) are included free with the App — no purchase is required to access any cosmetic content.
All purchases are processed by Apple through the App Store and are subject to Apple's refund policies. We do not receive or store any payment information.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your requirements
- The App will be uninterrupted, timely, secure, or error-free
- Game content, leaderboards, or scores will be accurate or reliable
- Any errors or defects in the App will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OMNI MERGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any loss of game progress, scores, or virtual items
- Unauthorized access to or alteration of your data
- Any third-party conduct, content, or advertisements
12. Indemnification
You agree to indemnify and hold harmless Omni Merge from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
13. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App. This includes but is not limited to cheating, score manipulation, or exploitation of game mechanics.
You may terminate your use at any time by deleting the App from your device.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by:
- Updating the "Last updated" date
- Posting notice in the App or App Store update notes
Your continued use of the App after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Omni Merge regarding the use of the App.
